SB 1047 CalCompute section 2024-08-29

Citation

California Legislature. SB 1047 (Wiener), 2023-2024 Regular Session, enrolled text of Aug. 29, 2024, Section 5, adding Gov. Code § 11547.6.1. https://leginfo.legislature.ca.gov/faces/billTextClient.xhtml?bill_id=202320240SB1047. Copy: raw/legislative/SB 1047 CalCompute section 2024-08-29.md. The full enrolled bill is beside it: raw/legislative/SB 1047 enrolled 2024-08-29.pdf. Read 2026-10-28.

The copy keeps the CalCompute paragraph of the Legislative Counsel’s Digest and all of Section 5, word for word. They are pdftotext lines 125-135 and 1015-1104 of the enrolled PDF. [...] marks the cuts.

Bottom line

  • SB 1047 had the first CalCompute section, Gov. Code § 11547.6.1. Its subdivisions (b) to (f) are almost word for word the text of SB-53’s Gov. Code § 11546.8. The seven Report elements, A to G, come from SB 1047.
  • SB-53 changed four things. It moved the Report due date from 2026 to 2027. It changed member selection. It added compensation and dissolution. It added “or other measure” to the operative clause.
  • The Governor vetoed SB 1047. The 2025 release on SB-53 refers to “his veto of Sen. Wiener’s SB 1047 last year” (ESP Governor signs SB-53 release 2025-09-29 (web)). § 11547.6.1 never became law.

Background

SB 1047 was Senator Wiener’s 2024 bill on large AI models. Section 5 added the CalCompute section. The Legislature passed the bill, and the Governor vetoed it. SB-53 (2025) carried the CalCompute text forward as Gov. Code § 11546.8 (SB-53 Gov Code 11546.8). The Governor signed SB-53 on Sept. 29, 2025.

Key claims

What is the same

  • Purpose, subd. (b). Both bills: the framework “advances the development and deployment of artificial intelligence that is safe, ethical, equitable, and sustainable” by “(1) Fostering research and innovation that benefits the public. (2) Enabling equitable innovation by expanding access to computational resources.”
  • University of California, subd. (c). Both bills: “The consortium shall make reasonable efforts to ensure that CalCompute is established within the University of California to the extent possible.”
  • Components, subd. (d). Both bills: “(1) A fully owned and hosted cloud platform. (2) Necessary human expertise to operate and maintain the platform.” SB 1047 (d)(3) says “facilitate use of CalCompute”. SB-53 (d)(3) says “facilitate the use of CalCompute”.
  • Labor law, subd. (e). Both bills: “The consortium shall operate in accordance with all relevant labor and workforce laws and standards.”
  • Seven elements, subd. (f)(2)(A)-(G). The same seven elements, in the same order. Two words differ. SB 1047 (B) says “recommendations on potential funding sources”; SB-53 (B) says “recommendations for potential funding sources”. SB 1047 (D) says “Recommendations on the parameters for use”; SB-53 (D) says “Recommendations for the parameters for use”.
  • SB-53 (g): “consist of 14 members as follows”.
  • Donations. SB 1047 (h) and SB-53 (j) both let the University of California “receive private donations for the purposes of implementing CalCompute”.

What differs

  • Placement, subd. (a). SB 1047: “There is hereby established in the Government Operations Agency a consortium”. SB-53: “There is hereby established within the Government Operations Agency a consortium”. The two texts differ by one word.
  • Due date, subd. (f)(1). SB 1047: “On or before January 1, 2026, the Government Operations Agency shall submit, pursuant to Section 9795, a report from the consortium”. SB-53: “On or before January 1, 2027”.
  • Member categories, subd. (g)(1). SB 1047 lists five categories with no count for each. Its fifth is “(E) Personnel from other relevant departments and agencies as necessary.” SB-53 lists four categories with fixed counts: four, three, three and four. SB-53 has no category (E).
  • Who selects members. SB 1047 (g)(2): “Eight members of the consortium shall be selected by the Secretary of Government Operations, and the President Pro Tempore of the Senate and the Speaker of the Assembly shall each select three members.” SB-53 (g): the Secretary of Government Operations appoints eight (paragraphs (1) and (4)), the Speaker three, and “the Senate Rules Committee” three.
  • Compensation and dissolution. SB 1047 has no such text. SB-53 adds (h), members “shall serve without compensation, but shall be reimbursed”, and (i), “The consortium shall be dissolved upon submission of the report”.
  • Operative clause. SB 1047’s own subd. (i) reads: “This section shall become operative only upon an appropriation in a budget act for the purposes of this section.” SB-53’s subd. (k) adds three words: “This section shall become operative only upon an appropriation in a budget act, or other measure, for the purposes of this section.”
  • Digest. SB 1047’s digest says “The bill would, on or before January 1, 2026, require the Government Operations Agency to submit a report from the consortium to the Legislature with that framework.”

Evidence and method

Enrolled bill text, the version the Legislature sent to the Governor. The comparison above sets the excerpt beside the SB-53 copy, raw/legislative/SB-53 Gov Code 11546.8.md, subdivision by subdivision.

Limits

  • SB 1047 is not law.
  • The copy is an excerpt. The rest of SB 1047 (rules for large AI model developers) is in the PDF only.
  • The copy does not give the veto date or the veto message. The veto fact comes from the ESP release.
